Terms of Service

Agreement and scope

These Terms form an agreement between you and the operator of NookSMP. They apply together with published server rules, purchase information and the Privacy Policy. If you do not agree, do not use the services.

NookSMP is an independent community server. It is not affiliated with, endorsed by, sponsored by or approved by Mojang Studios or Microsoft.

Eligibility and guardians

You must have a genuine, properly licensed Minecraft account and be legally permitted to use the services. If you are under the age at which you can enter a binding agreement where you live, a parent or legal guardian must review and accept these Terms for you.

Parents and guardians are responsible for supervising a minor's use of the services and any purchases made by or for that minor.

Accounts and identity

Your Minecraft account, username and UUID identify your NookSMP account. You are responsible for activity performed through your account and for keeping your Microsoft and Minecraft credentials secure. NookSMP staff will never ask for your password or authentication code.

Do not sell, transfer, share or impersonate accounts to evade enforcement or obtain another player's property. Tell us promptly if you believe your account has been compromised.

Acceptable conduct

You must follow server rules and staff directions. You must not cheat, exploit bugs, duplicate items, attack the service, distribute malware, phish, harass others, evade sanctions, manipulate the economy through coordinated abuse or use unauthorised automation.

Do not publish unlawful, infringing, hateful, sexually explicit, threatening or personally identifying content. Competitive gameplay does not excuse abuse directed at other people.

Virtual items and currencies

Money, Nook Shards, ranks, kits, cosmetics, keys, items and other in-game benefits are limited licences to use features inside NookSMP. They are not legal tender, stored value or property with cash value. They cannot be redeemed for cash and may not be sold or traded for real-world value.

We may balance, rename, replace or remove virtual content when reasonably required for gameplay, security, legal compliance or service integrity. We will not knowingly remove a paid entitlement without a valid operational, enforcement or legal reason.

Purchases and delivery

Prices, taxes, package contents and billing currency are shown before purchase. Payments may be processed by an external commerce provider. You authorise the displayed charge when you complete checkout.

You must provide the exact Minecraft Java username requested at checkout. Delivery may occur while you are offline. Order identifiers are used to prevent duplicate fulfilment. A rank purchase upgrades an eligible account and does not intentionally downgrade an existing higher rank.

Refunds and chargebacks

Digital content is normally delivered immediately and is generally non-refundable after successful delivery, except where required by law or where we approve a request for duplicate, defective or undelivered content. Contact netherite@nooksmp.net with the order identifier and Minecraft username.

Unauthorised chargebacks, payment fraud or materially false refund claims may result in reversal of related entitlements and account restrictions while the matter is reviewed. Nothing in these Terms excludes guarantees, remedies or other rights that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law.

Moderation and enforcement

We may investigate suspected breaches using server records, moderation history and relevant technical information. Enforcement may include warnings, content removal, mutes, temporary restrictions, bans, entitlement reversal or termination.

We aim to act reasonably, but urgent action may be taken without advance notice to protect players, the economy or the service. You may request review by emailing support with your username and relevant context.

Service availability and changes

The services may be changed, suspended or unavailable because of maintenance, faults, attacks, platform changes, capacity limits or events outside our reasonable control. We do not promise uninterrupted availability, a particular player count or permanent access to any world, season or feature.

We may reset worlds, economies, rankings or progression when reasonably needed. Where practical, material planned changes will be announced through official NookSMP channels.

Player content

You retain rights you hold in builds, messages and other content you create. You grant NookSMP a worldwide, non-exclusive, royalty-free licence to host, reproduce, moderate and display that content only as needed to operate, secure and promote the services.

You confirm that your content does not violate another person's rights. Public chat, builds and gameplay may be seen, recorded or shared by other players.

Intellectual property

NookSMP branding, original code, written material and original artwork remain the property of their respective owners. You may not copy, sell or misrepresent them without permission.

Minecraft, Mojang Studios, Microsoft and related marks and assets belong to their respective owners. Your use of Minecraft remains subject to the Minecraft End User Licence Agreement and Usage Guidelines.

Third-party services

The services may link to or depend on third-party platforms, including Minecraft, Microsoft, hosting, payment and community providers. Their terms and privacy practices apply separately. NookSMP is not responsible for a third party's independent acts or outages.

Disclaimers and liability

To the maximum extent permitted by law, the services are provided as available and without implied promises beyond those that cannot lawfully be excluded. We are not liable for indirect, incidental, special or consequential loss, lost profits, lost data or loss caused by another player.

Where liability cannot be excluded, it is limited to the remedy or amount required by applicable law. These limitations do not apply to fraud, wilful misconduct or liability that cannot legally be limited.

Indemnity

To the extent permitted by law, you agree to compensate NookSMP for reasonable loss and third-party claims caused by your unlawful conduct, your material breach of these Terms or content you provide. This does not require you to compensate us for our own negligence or misconduct.

Termination

You may stop using the services at any time. We may restrict or end access for a serious or repeated breach, security risk, legal requirement or permanent closure of the service. Provisions that by their nature should continue, including payment, intellectual property, liability and dispute provisions, survive termination.

Changes and governing law

We may update these Terms to reflect service, legal or operational changes. The effective date will be updated and material changes may be announced. Continued use after a change takes effect means you accept the revised Terms.

Unless mandatory law requires otherwise, these Terms are governed by the laws of New South Wales, Australia. Courts with jurisdiction in New South Wales may hear disputes. Before starting formal proceedings, please contact us and allow a reasonable opportunity to resolve the issue.
